Estate Administration, Contested Wills & Family Provision Claims

The passing of a loved one can be a very emotional and difficult experience, which is often complicated when trying to work out what to do next. Dombrovski Legal is able to provide professional and compassionate assistance to families in administering an Estate, including assisting with applications for Grant of Probate or Letters of Administration where required.

The Succession Act 2006 sets out that there are some circumstances where individuals can contest a Will to seek further provision where insufficient provision has been made for that person’s maintenance, education or advancement in life. This is known as a Family Provision claim.

In addition, a Will can also be challenged if it is not legally valid. This can include circumstances where the person who made the Will does not have testamentary to create the will, or because of concerns of fraud, forgery or undue influence over the person making the Will.

Dombrovski Legal can advise as to whether you are a person who is eligible to lodge a claim for further provision, and assist you through that process. Dombrovski Legal can also provide advice to Executors of estates where there is a risk of a family provision claim being lodged or there are other claims raised in relation to the validity of a Will.
