The Succession Act 2006 sets out that there are some circumstances where individuals can contest a Will to seek further provision where insufficient provision has been made for that person’s maintenance, education or advancement in life. This is known as a Family Provision claim.
In addition, a Will can also be challenged if it is not legally valid. This can include circumstances where the person who made the Will does not have testamentary to create the will, or because of concerns of fraud, forgery or undue influence over the person making the Will.
